Terms of Sales
1. PREAMBLE
In these general conditions of sale (GTC), the words below will have the following meaning: Establishment: natural or legal person offering services for sale and reservation Client/Buyer: natural or legal person making a purchase and /or a reservation with the establishment Beneficiary: refers to the natural or legal person benefiting from a reservation code and reserving their service with the establishment Gift voucher: commercial offer allowing the customer to offer a predefined service to the beneficiary of their choice Gift card: commercial offer allowing the customer to offer an amount to be spent by the beneficiary at the establishment Offer: refers to a gift voucher offered by the establishment Les vergers et la tiny house: Place in which the Establishment offers its services to Customers Participation: amount paid by a customer to participate in the adventure (excluding deposit)
These general conditions of sale take place between:
On the one hand, the company SCEA Les Vergers de la Rouérie with a share capital of €100, hereinafter referred to as The Establishment whose registered office is located at La Rouérie – 53200 GENNES LONGUEFUYE, registered in the Trade and Companies Register under the SIRET 92080657700010; legally represented by Mr. Samuel RUAULT and Ms. Mélanie RUAULT, duly authorized as managers for the present purposes
On the other hand, The customer.
The Establishment has a self-generated solution allowing customers to book services online. The establishment using this solution offers booking services specific to its activity. These are accessible via its website www.vergersdelarouerie.com and potentially any other partner site. These conditions governing the terms of sale and reservation of the services offered by the Establishment, it is advisable to consult them carefully before committing yourself.
ARTICLE 1: GENERAL PROVISIONS
These conditions apply: • to the reservation of services offered by the establishment • to the online reservation of a service obtained thanks to a gift voucher. These T&Cs are valid from January 6, 2023. They replace any other form of T&Cs previously in force relating to the reservation of services. The establishment reserves the right to modify the GCS, although such a modification is inapplicable to contracts concluded beforehand respecting the GCS associated with said sales. Any customer, before committing, certifies to be able to conclude a contract as provided for in articles 1123 and 1224 of the civil code. Any customer, before committing, must read the general conditions of sale of the establishment and accept them.
ARTICLE 2: SERVICES OFFERED
Section 2.1 Reservation of services The Customer can reserve a service offered by the establishment for a specific date. The photos and videos describing the services of the various services are not contractual. The services are available for reservation on the site www.vergersdelarouerie.com. When booking online, the Customer can enter the desired dates for the service according to the availability of the establishment. Once an agreement on the dates has been found, the Customer is redirected to a platform for configuring the service and confirming the purchase. It is the customer's responsibility to fill in his personal information in such a way as to identify him as provided for in article 1316-1 of the civil code.
Section 2.2 Reservation of a date to hold a gift voucher service. The beneficiary of a gift voucher can reserve the date for the performance on the site www.vergersdelarouerie.com. To do this, he must fill in the field provided that he does indeed have a gift card associated with his service. He will be contacted by the Establishment to provide the gift card code before paying for the reserved service. He can therefore choose his date of stay according to the availability of the establishment.
ARTICLE 3: PRICES AND PAYMENTS
Section 3.1 Price of services The prices for each service are inclusive of all taxes. When booking the service, the customer can add options to the initial offer. The price of the options is to be added to the announcement price of the service. The establishment reserves the right to change prices, without retroactive application to reservations made prior to this change.
Section 3.2 Payment of benefits Section 3.2.a Payment for the stay in the tiny house: for reservations of nights in the tiny house made through our online reservation system or by telephone or e-mail, a secure remote payment link will be sent to you within 24 hours following the sending of your reservation voucher. This link allows you to pay for the service remotely from your bank card. The amount of the stay will be debited from your credit card in full upon booking. You will also be able to pay in full by bank transfer or bank check at the time of booking. In this case, the reservation is optional for 7 days. Receipt and collection of payment within this period will validate the reservation. The reservation option is automatically lifted in the event of late payment for the stay, the option period being set at 7 days. The reservation is considered confirmed only when it is fully paid.
Section 3.2.b Payment by credit card. The bank data relating to the card used by the customer must be entered in the corresponding fields, namely the card number, the security code, and the expiry date of the said card. As provided for in article L.133-8 of the Monetary and Financial Code, payment by card is an irrevocable commitment, once given. The establishment reserves the right to accept or not the deferred payments, otherwise, the payment is entirely due to conclude the purchase of the offer. In case of error or refusal of payment, the transaction is considered as unsuccessful, the purchase is then suspended. Securing payments is guaranteed by a Distance Selling solution from the SUMUP platform, which the Establishment uses. The Customer's account is debited upon confirmation of payment. The reservation is then considered effective.
Section 3.2.b Payment by bank transfer The Customer can pay for his reservation by bank transfer to the attention of the establishment. If necessary, the reservation is maintained with an option status for 7 days. The Customer has 7 days from this first reservation to send the payment to the Establishment. To do this, the latter will send an email to the Customer containing the information of the account to which the money must be transferred. The sum must be paid in full into the bank account of the Establishment. Transfer costs are the responsibility of the customer. The validation of the reservation will be effective upon receipt of the bank transfer.
Section 3.2.c Other means of payment The Customer can make a reservation by paying by bank check payable to SCEA Les Vergers de la Rouérie. Bank checks must be sent by post within 7 days to the order of SCEA Les Vergers de la Rouérie, to the following address: SCEA Les Vergers de la Rouérie, La Rouérie – 53200 GENNES LONGUEFUYE. It is imperative that the Customer indicates the reference of the reservation in the postal mail accompanying the means of payment. The establishment recommends sending by registered mail with acknowledgment of receipt. If necessary, the reservation is maintained with the status of option for 7 days from the date of the initial reservation. The validation of the reservation will be effective upon receipt of the means of payment.
ARTICLE 4 - CONFIRMATION
Section 4.1 Reservation of services As soon as the payment has been made and validated, the customer receives a confirmation email containing the details of the reservation in a rental contract which will be attached as an attachment. Section 4.2 Reservation of a gift voucher service. Upon confirmation of the reservation of the gift voucher service, the customer receives a confirmation email containing the details of the reservation in a rental contract which will be attached as an attachment. The gift code and the reservation number are to be kept by the Customer.
ARTICLE 5 - COMPLAINTS
Any complaint relating to a stay must be sent by registered letter with AR within 30 days of the stay to the following address: SCEA Les Vergers de la Rouérie - La Rouérie - 53200 GENNES LONGUEFUYE. In the event of an error in sending the confirmation email, the customer has a claim period of 14 days from the date of receipt of the email to inform the Establishment. In the event of loss or theft of the confirmation email containing the reservation number, it is necessary to notify the establishment within 14 days of the incident being detected.
ARTICLE 6 – MODIFICATION OR CANCELLATION OF THE RESERVATION
For any modification or cancellation of the reservation, a notification including the reservation number. must be sent by email to the establishment at samuelruault@hotmail.com.
Section 6.1 Conditions for cancellation or modification of the stay by the customer For any canceled stay, the following conditions apply:
– more than 30 days from the date of arrival, 10% of the amount of the accommodation rental will be retained by the establishment.
– between 30 and 8 days before the stay, 50% of the rental amount of the accommodation will be withheld.
– for any stay canceled within 7 days prior to the date of arrival, interrupted or not consumed, the entire amount of the reserved stay will be payable or will be retained by the Establishment.
For any modified stay in the tiny house due to the Customer:
- More than 30 days before the stay, the modification can take place free of charge, subject to availability, for the current calendar year only. In case of postponement to the following calendar year, an administrative fee of 5% on accommodation will be payable in addition.
- No modification of the date of holding of the service is accepted if the notification to the establishment takes place within 30 days preceding the date of holding of the stay.
Special casesIn the event of a PCR or antigenic test (done in a pharmacy) positive for covid-19, the stay in the tiny house may be postponed free of charge within 12 months of the cancellation, on medical proof only. No refund can be requested. For all stays, in the event of confinement or restrictive measures by the Government or the Prefecture prohibiting the stay from taking place in whole or in part, the Establishment offers the Client the postponement of the stay within 18 months. The Customer has 18 months to postpone his stay from the initial date of the stay.
Section 6.2 Conditions of modification and cancellation by the Establishment. In the event of administrative closure ordered by the Government or the Prefecture due to a health or security emergency crisis such as that linked to covid-19, the Establishment offers the Customer the postponement of his stay to a later date in the current 18 months. The client has 18 months to postpone his stay from the initial date of the stay. In the event of a breach of the Establishment's Internal Regulations (drunkenness, noise pollution), the Establishment may cancel the Customer's stay without the Customer being able to request a refund. If your booking follows a gift voucher, the general conditions of sale concerning Gift Vouchers apply (see Article 6.3): Gift Vouchers are non-refundable. The reservation can be postponed free of charge within 12 months.
Section 6.3 Conditions specific to gift vouchers: Gift vouchers are non-refundable. The date on which the service is held may be modified under the same conditions as those governing the booking of a service. In the event that the beneficiary of the voucher has not been able to reserve the gift voucher within the limits of the validity dates, the Establishment may grant an additional period of validity of up to one year; provided that the beneficiary has notified the establishment two weeks before the end of the initial period of validity. Invoices for gift vouchers sold by SCEA Les Vergers de la Rouérie are issued on the day of purchase in the buyer's name. Before booking the stay online or by telephone, the gift voucher is deemed to belong to the person who paid for the gift voucher. Once the reservation has been confirmed, the Establishment guarantees that the stay will be held with the person whose name appears on the reservation.
ARTICLE 7 - SPECIAL CONDITIONS
- Access to the tiny house is possible for all adults and children of all ages. Access to the swimming pool will be made for children under the control and responsibility of the referring adult who has contracted the rental of the accommodation. Under no circumstances can the SCEA Les Vergers de la Rouérie be held responsible for an accident occurring in the swimming pool adjoining the tiny house during the duration of the stay.
• Arrival times: the customer must arrive preferably between 3 p.m. and 6 p.m. for the delivery of the keys to his accommodation. In the case of an arrival after 8 p.m., the customer can choose the paying option "late arrival". He must inform the Establishment of this before his stay, by telephone on 06 77 80 22 03 or by email at samuelruault@hotmail.com. If you choose the Immersion formula: the client must arrive between 9am and 10am to allow the participatory activities to start on the first day of their stay. In the case of delay, the customer must inform the Establishment by telephone on 06 77 80 22 03 or by email at samuelruault@hotmail.com.
• Pets: Customers' pets are not allowed in our accommodation, nor on the entire estate.
• Valuables: It is recommended not to leave valuables in the accommodation. The Management cannot be held responsible for theft or loss in accommodation.
• Alcoholism and cigarettes: It is strictly forbidden to be intoxicated in the accommodation and in the Establishment. Smoking is not allowed inside the accommodation and in the farm and orchards for safety reasons. It is tolerated to smoke on the terrace of the accommodation insofar as no cigarette butt will be thrown in nature.
• Rules of procedure: The rules of procedure will be given to you with the rental contract and are accessible in the accommodation. In the event of non-compliance with the internal regulations, the Establishment may decide to exclude the Client from the domain, without the latter being able to claim compensation.
ARTICLE 8 - GUARANTEES
As established in article L.211-4 of the Consumer Code, the establishment undertakes to respect the various contractual guarantees then provided. The establishment certifies that it holds liability insurance in line with the activity carried out. This provision applies to the beneficiary who must have sufficient civil liability insurance in the context of the rental of holiday accommodation.
ARTICLE 9 - MODIFICATION AND NULLITY OF THE CONDITIONS
The modification of one of the clauses of the purchase contract can be modified with the written agreement of both parties. The fact that the establishment does not take advantage of one of the clauses of these general conditions of sale does not stipulate the renunciation of the latter to inquire about this condition later. The nullity of one of the provisions of the GCS does not entail the nullity of these conditions.
ARTICLE 10 - INTELLECTUAL PROPERTY RIGHTS
The establishment distributes its offers on the site www.vergersdelarouerie.com as well as on that of www.gites-de-france.com as well as on potential partner sites, the content appearing on the latter (photos, videos, etc. ) is the property of the establishment and may not be reproduced without prior authorization. If necessary, the establishment has the right to take legal action against the natural or legal person responsible for this damage.
ARTICLE 11 - PROTECTION OF PERSONAL DATA
The information submitted to the establishment by the client remains confidential. According to Law No. 78-17, Informatique et Libertés, of January 6, 1978, the customer has a right to consult, rectify or withdraw this information. Any request relating to personal data should be made to the establishment by letter to the following address, SCEA Les Vergers de la Rouérie - La Rouérie - 53200 GENNES LONGUEFUYE.
ARTICLE 12 - FORCE MAJEURE
The service will be suspended in the event of force majeure which prevents the establishment from fulfilling its obligations under the contract; if the case of force majeure persists beyond 3 months, the suspension of the contract may be considered final. If necessary, the Establishment has a period of 14 days, from the moment it becomes aware of it, to notify the customer. The reimbursement conditions will be subsequently and individually assessed according to the Establishment.
ARTICLE 13 - APPLICABLE LAW
These general conditions of sale are governed by French law, as are the conditions of execution, termination and evaluation of the contract as well as the settlement of disputes.
